Return, Refund & Cancellation Policy

This Return, Refund & Cancellation Policy (“Policy”) applies to all purchases made through www.poppydrive.com (the “Website”) operated by Poppy Drive Inc. (“Poppy Drive,” “we,” “us,” or “our”).
By placing an order, you acknowledge that you have read, understood, and agreed to this Policy.
1. Scope & Application
This Policy applies exclusively to online purchases shipped within Canada.
Poppy Drive operates solely as an e-commerce retailer and does not maintain physical retail locations.
Nothing in this Policy limits any non-waivable rights granted under applicable Canadian consumer protection legislation.

2. Return Eligibility (30-Day Limited Return)
We accept returns requested within 30 calendar days from confirmed delivery.
To qualify, products must:
- Be unworn, unused, unwashed
- Be free of stains, odor, pet hair, damage, or alteration
- Have original tags attached
- Be returned in original packaging
- Be accompanied by valid proof of purchase
Return authorization must be obtained prior to shipment. Unauthorized returns will be refused.
Poppy Drive retains sole discretion to determine whether returned merchandise meets eligibility standards.

3. Non-Returnable & Final Sale Items
The following are strictly non-refundable and non-returnable:
- Items marked “Final Sale” at checkout
- Clearance merchandise
- Gift cards
- Intimate apparel (including underwear and bodysuits)
- Customized, altered, or special-order items
- Products discounted 30% or more
- Worn, washed, or damaged items
Final sale designations are disclosed prior to purchase in accordance with Canadian e-commerce regulations.

4. Inspection & Rejection of Returns
All returns undergo inspection upon receipt.
We reserve the right to reject any return that:
- Fails to meet eligibility conditions
- Appears worn or used
- Shows signs of laundering
- Contains fragrance, deodorant, makeup, or stains
- Has missing or reattached tags
- Is returned incomplete
If rejected:
- The item will be returned to the customer at their expense; or
- If shipping fees are unpaid within 10 business days, the item may be disposed of without liability.

5. Refund Terms
Approved refunds:
- Are issued to the original method of payment only
- Exclude original shipping charges (unless legally required otherwise)
- Are processed within 5–10 business days of approval
- May require additional time by the payment processor
Refunds will not be issued in cash.
If the original payment method is unavailable, store credit may be issued at our discretion.

6. Return Shipping & Risk of Loss
Customers are responsible for return shipping costs unless the item is confirmed defective or incorrect.
Risk of loss remains with the customer until delivery to Poppy Drive is confirmed.
We strongly recommend insured and trackable shipping.
Poppy Drive is not responsible for:
- Lost return shipments
- Shipping delays
- Carrier damage

7. Defective or Non-Conforming Goods
Under applicable Canadian consumer protection laws, customers are entitled to remedies where goods are materially defective or not as described.
Claims must be submitted within 7 days of delivery and must include:
- Order number
- Clear photographic evidence
Upon verification, Poppy Drive will, at its sole discretion:
- Replace the item;
- Repair the item (if applicable); or
- Issue a full refund including original shipping charges.
Normal wear and tear, improper care, accidental damage, or misuse do not constitute defects.

8. Internet Agreement Cancellation Rights
In accordance with applicable provincial consumer protection legislation governing internet agreements:
A customer may cancel an order if:
- Required disclosure information was not provided;
- A written confirmation was not received within 15 days;
- The order is not delivered within 30 days of the stated delivery date.
Where cancellation rights apply:
- Notice must be provided in writing;
- Refunds will be issued within 15 days of valid cancellation.
This clause applies only to statutory cancellation rights and does not extend the voluntary 30-day return period.

9. Exchanges
We do not guarantee product exchanges due to inventory limitations.
Customers must place a new order after completing a return.

10. Chargebacks & Fraud Prevention
Customers agree to contact Poppy Drive prior to initiating a chargeback.
We reserve the right to:
- Contest fraudulent or abusive chargebacks
- Suspend or terminate accounts
- Refuse future transactions
- Pursue legal remedies where appropriate
Excessive or suspicious return activity may result in account restrictions.

11. Limitation of Liability
To the maximum extent permitted by law:
Poppy Drive’s total liability is limited to the purchase price paid for the product in question.
We shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits
- Loss of data
- Shipping delays outside our control
Nothing in this clause excludes liability where prohibited by law.

12. Force Majeure
Poppy Drive is not liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to:
- Natural disasters
- Carrier disruptions
- Government actions
- Labor disputes

13. Governing Law
